Contract Duration: For initial appointments, the Court offers a two-year appointment with the possibility of extension (six month probationary period).A roster of suitable candidates may be established for this post as a result of this selection process for fixed-term appointments against both established posts and positions funded by general temporary assistance (GTA).Organizational contextThe Office of Public Counsel for the Defence was established under Regulation 77 of the Regulations of the Court for the purposes of, inter alia, providing assistance such as representing and protecting the rights of the defence during the initial stage of the investigation, providing support and assistance to defence counsel and to the person entitled to legal assistance including legal research and advice, appearing before the Chamber on specific matters, advancing submissions with the leave or on the instructions of the Chamber. The Office of Public Counsel for the Defence functions in its substantive work as a wholly independent office and falls within the remit of the Registry for administrative purposes under the umbrella of the Division of Judicial Services.Duties and responsibilitiesIn addition to the direction and supervision of the work of the other members of the Office, the incumbent will perform the following duties:- Provide persons under investigation with the necessary legal assistance and support in accordance with the Statute, the Rules of Procedure and Evidence, the Regulations of the Court and other applicable rules;- Provide support and legal assistance to defence teams and, subject to conflict of interests with other accused persons, to the latter in particular through legal research and advice, or acting on their behalf in respect of specific issues;- Produce factual background documents on the situations before the Court;- Produce research papers and providing advice on selected aspects of international criminal law;- Appear before a Chamber of the Court, as and when required, and particularly on behalf of defence teams located out of the Host State;- Liaise with other sections and organs of the Court.Qualifications and experienceEducation:An advanced university degree in law. Admission to practice in law in any State.Experience:The candidate must have established competence in international or criminal law and procedure, as well as at least 10 years of experience (12 years with a Bachelor of Arts or equivalent), whether as judge, prosecutor, advocate or in other similar capacity, in criminal proceedings. Experience before international criminal jurisdictions would be considered an important asset. The candidate should also have an excellent understanding of the norms and procedures of the Court, including: the Rome Statute, the Rules of Procedure and Evidence, the Elements of Crimes, the Regulations of the Court, the Regulations of the Registry and the Code of Conduct for Counsel.Skills and abilities:- Tact, discretion and accuracy in handling confidential information.- Ability to establish and maintain effective working relations in the Office of Public Counsel for the Defence and with the representatives of different legal and cultural backgrounds.- Excellent drafting skills, interpersonal skills and communication skills, preferably including experience in a multi-cultural setting.- Strong organisational skills.-Ability to demonstrate sound judgement, loyalty and discretion, particularly in the handling of sensitive information.-Team management skills.Knowledge of languagesFluency in both of the working languages of the Court, English and French is required. Knowledge of another official language of the Court would be considered an asset.Special note:The incumbent of this post will participate in the Court's Financial Disclosure Programme, administered on behalf of the ICC by the United Nations Ethics Office (UNEO). Realising objectivesLearn more about ICC and .Candidates appointed to posts at a P-5 grade or in the Director category are subject to a maximum aggregate length of service of seven years. This is pursuant to a decision of the Assembly of States Parties (ASP Resolution ICC-ASP/23/Res.2 - ) to implement a tenure policy at the Court as of 1 January 2025.- The selected candidate will be subject to a Personnel Security Clearance (PSC) process in accordance with ICC policy. The PSC process will include but will not be limited to, verification of the information provided in the personal history form and a criminal record check.- Applicants may check the status of vacancies on ICC E-Recruitment web-site.- Post to be filled by a national of a State Party to the ICC Statute, or of a State which has signed and is engaged in the ratification process or which is engaged in the accession process.
